What the rules require

The retention periods and obligations that apply in this sector, and what they ask of your ICT.

Being able to look back seven years

In the Netherlands, tax records are kept for seven years and real estate records for ten. That calls for backups that stay readable for that entire time.

Wwft

Recording client due diligence

Accountants, tax advisers, notaries and financial institutions, among others, are subject to the Dutch anti-money laundering act (Wwft). Client due diligence data is kept for five years after the relationship ends.

Beroepsgeheim · AVG

Confidential stays confidential

Lawyers and notaries have a duty of confidentiality, and the GDPR requires appropriate security of personal data. Personal accounts, two-factor authentication and encrypted sending are part of that.

Always verify payment requests

A fixed callback procedure for every payment request or changed account number is the best defence. We take care of the technical side: filtering and two-factor authentication.

Throughout the year

For advisers and accountants, the Dutch tax return season runs from 1 March to 1 May. In wholesale, the peak is often in the autumn, in the run-up to the holidays.

Questions from practice

What organisations in this sector ask us most often.

How long do we need to keep client files and records?

+

Seven years for tax purposes, ten years for real estate. Data from Wwft client due diligence is kept for five years after the relationship ends. A properly set up backup keeps everything retrievable.

Can we just email confidential documents?

+

Preferably via a secure link or encrypted email, from your own mailbox. A regular attachment stays unprotected in mailboxes.

How do we prevent CEO fraud and invoice fraud?

+

With two-factor authentication, email filtering and a fixed callback procedure for every payment request or changed account number. We handle the technology; we agree the procedure together.

Does our organisation fall under the Cybersecurity Act (NIS2)?

+

That depends on the sector and size. Banks and larger food wholesalers may fall under it directly. Clients who do fall under it can also impose requirements on your security as a customer.
